Article II. Parking Cutback Permit

(a) It shall be unlawful for any person to cut or remove the curbing and guttering of any improved street or avenue for the purpose of widening the paving or roadway of such street or avenue by cutting back the parking, unless approved by the City Engineer or designee.

(b) The City Engineer or designee may approve requests to cut and remove curbing and guttering for the purpose of widening the street for vehicular parking purposes if all of the following requirements are satisfied:

(1) The street is not a major thoroughfare, major trafficway or through-street designated in the master street plan;

(2) The plans do not include cutting or removing of curbing within 20 feet of the property line extended at the intersection of two streets unless approved by the City Engineer or designee;

(3) The interior of the area to be protected by a curb adjacent to the sidewalk and at either end of the area is sufficiently high and wide to prevent encroachment or standing of any vehicle upon the sidewalk or unpaved area adjacent thereto;

(4) All areas cut back in the street parking are paved by concrete or other permanent paving material approved by the City Engineer or designee; and

(5) The property owner agrees to repair, maintain and clean the cutback area. (Ord. 19999 § 1, 5-17-16.)
