8.20.070 Where smoking is not regulated – Private and public places.

Notwithstanding any other provision of this chapter to the contrary, the following areas shall not be subject to the smoking restrictions of this chapter:
(a) Private residences, except when used as a day care home as defined in K.S.A. 65-530, and amendments thereto, adult day care as defined in K.S.A. 39-923, and amendments thereto, or health care facility.
(b) No more than 20 percent of hotel or motel rooms which are available to be rented to guests.
(c) Smoke shops.
(d) Outdoor places of employment.
